Suspension of IAS officers: no intervention by govt in one year

"The central government has not intervened in any disciplinary action taken by states in last one year," Minister of State V Narayanasamy told the Upper House

The central government has not intervened in any disciplinary action taken by states against IAS and IPS officers in the last one year, the Rajya Sabha was informed today.

"The central government can intervene in any disciplinary action taken by the state government in case an appeal is preferred or memorial is submitted by a member of service subject to the conditions stipulated under the relevant rules.

"The central government has not intervened in any disciplinary action taken by states in last one year," Minister of State for Personnel, Public Grievances and Pensions V Narayanasamy told the Upper House in a written reply.

The state government can take disciplinary action against IAS, IPS officers serving under them under Rule 7 (1) (b) of the All India Services (Discipline and Appeal) Rules, 1969.

However, the penalty of dismissal, removal or compulsory retirement shall not be imposed on a member of the service except by an order of the central government.

It is pertinent to mention that Uttar Pradesh government has late last month suspended Durga Sakthi Nagpal,a 2010 batch IAS officer, who had cracked down on sand mining mafia active in Gautam Budh Nagar area of the state.

Nagpal was suspended ostensibly for ordering demolition of a wall of a local under-construction mosque allegedly without following the due process. Her suspension has caused nation-wide outrage among civil society and civil services officers' association. They had demanded her immediate reinstatement and taken up the matter with the Centre.
