A division bench of Chief Justice R Subhash Reddy and V M Pancholi today issued notice to the state government seeking a reply and posted the hearing to June 30.
The ordinance, issued last month, did away with the NRI quota and increased the management quota from 10 per cent to 25 per cent.
As per the new rules, students applying for MBBS course in self-financed private colleges should have completed class 12th from a Gujarat-based school and must be domiciled in Gujarat for admission in management quota.
Abolition of the NRI quota is unconstitutional as this quota was introduced across India following a Supreme Court judgement, the petition says.
