Marxist veteran and CPI-M leader V S Achuthanandan today found fault with the Kerala High Court order which had held that there was no material to show that Chief Minister Oommen Chandy had vouched for the credentials of the solar energy company, whose promoters had allegedly cheated several persons of huge sums.
In a statement here, he said the court order yesterday rejecting a private petition in this regard had taken into account even issues that did not come under the scope of the petition.
He said this order could even be "misused" by the police team investigating the case for the benefit of the accused while submitting the final charge sheet in the lower court.
In a relief to Chandy, a single bench of the High Court had held there was no material before it to show he had given any assurance to entrepreneur Sreedharan Nair, one of the complainants in the solar case, about the credentials of 'Team Solar', the company floated by accused Saritha S Nair and Biju Radhakrishnan, and had encouraged him to do business with the company.
The observation was made by Justice Harun-Ul-Rashid while dismissing a petition by Joy Kaitharath, seeking a direction to the government to verify the computer hard discs and servers of CCTV cameras and web cameras in the secretariat and offices of the Chief Minister and retrieve the entire data.
