BJP approaches ECI seeking disqualification of 21 AAP MLAs

BJP's Delhi unit today approached the Election Commission of India seeking disqualification of 21 Aam Aadmi Party legislators who were appointed Parliamentary Secretaries last year by the AAP government in "violation of the Constitution".
A BJP delegation met ECI principal secretary K F Wilfred and submitted a memorandum demanding the commission's recommendation to the President of India for disqualifying 21 AAP MLAs on ground of occupying 'office of profit', said party spokesman Praveen Kapoor.
"According to the Constitutional provisions, only one Parliamentary Secretary can be appointed in Union Territory of Delhi and this secretary could be appointed only in the office of the chief minister. Hence all these appointments are unconstitutional," said Delhi BJP president Satish Upadhyay, who led the delegation.
Leader of Opposition in Delhi Assembly Vijender Gupta claimed that the Kejriwal government was "well aware" that these appointments were "illegal". "That is why it (AAP) had tried to get a resolution passed to give 'retrospective' effect to them," Gupta alleged.
