Ritesh Kumar, who was driving the BMW was arrested under Indian Penal Code Sections 279 (rash driving or riding on a public way) and IPC 304A (causing death by negligence), East Midnapore SP Alok Rajoria told PTI.
A complaint was lodged by a local witness after family members of the deceased trio did not file any complaint against anybody, Rajoria said.
"Because he was driving the vehicle he was somehow responsible for the mishap that happened yesterday. We need to look into his role also," Rajoria said.
The SP also dismissed that the accident was a result of racing between the two vehicles.
"There was no question of any racing between the two vehicles. And we have enough evidence that these two groups did not know each other ... Head-on collision does not happen when two vehicles are racing and in fact there were damages on side portions of both the cars," he said.
