Since both the complaints were at the initial stage, the AAP leader was not required to be present before the Court which asked Delhi Police to file an action taken report (ATR) in the case of alleged bribe related remark and the second case was put for recording of pre-summoning evidence in support of allegations against Kejriwal.
While hearing submissions on the plea filed by advocate and complainant Arun Kumar, Metropolitan Magistrate Richa Gusain Solanki fixed April 9 for recording pre-summoning evidence.
It asked that after the inquiry, whether any cognizable offence was made out against Kejriwal and if yes, whether any FIR has been registered and also to inform about the status of the investigation.
Sharma has sought registration of FIR against Kejriwal for the alleged offences including abetment, offering or accepting bribe and punishment for bribery under the Indian Penal Code.
During the hearing, Kumar submitted that Kejriwal has instigated the public to take bribe from political parties.
"Kejriwal has asked voters to take money from Congress and BJP but to vote for his party," the advocate appearing in person said.
He also said the Election Commission had issued notice to the former Delhi chief minister and later directed him not to make such remarks, warning him of strict action in the event of any violation.
In his complaint, Kumar has alleged that Kejriwal, despite himself being a former Delhi chief minister and knowing that acceptance of bribe is punishable under law, instigated the voters to do such a thing.
