Expressing dissatisfaction with the CBI's probe against two IPS officers in a case of alleged custodial torture and death of a murder accused in 2010, a court in Kerala today ordered the agency to conduct further investigation and submit a 'meaningful report'.
Rejecting the supplementary chargesheet of CBI, filed after excluding the names of the IPS officers -- ADGP Mohammed Yasin and DIG Vijay Sakre, Chief Judicial Magistrate (CJM) E C Harigovind said he was not satisified with the probe against the two officials.
The CJM said the probe by the CBI was 'incomplete' and it was not satisfied with the investigations against Yasin and Sakre and said their role should be investigated in detail.
The post-mortem of victim Sampath had revealed lot of injuries inflicted with a cane baton. The baton should be scientifically examined, the court held.
Sampath and two of his accomplices had been arrested from Coimbatore after the murder of a housewife in Palakkad in March, 2010. Sampath died on March 29 while in police custody.
The court pointed out that Yasin had summoned Satish, former Thiruvananthapuram Collector and brother of the murdered woman at least eight times. But this was not investigated by CBI.
The CBI had filed the supplementary chargesheet on Sept 15 last year excluding the two IPS officials.
The order was issued on a petition by Sampath's brother Murukesan, who challenged the decision to exclude Yasin and Sakare, the then Thrissur range IG and Palakkad SP respectively.
Civil police officers Johnson Lobo, T J Brijith, Shillan and P A Abdul Rasheed, Assistant Sub-Inspector K Ramachandran, head constable Madhavan and CI Vipindas are arraigned in the supplementary chargesheet.
CBI had earlier chargesheeted four police personnel-- the then DySP C K Ramachandran, SI Vipin Das SI PV Ramesh, Civil Police officer Shyamaprasad and Binu Ittoop of Palakkad.
