The Bombay High Court today refused to stay the bail granted by a sessions court to two persons in custody in connection with a fake membership scam at the Cricket Club of India (CCI) here.
The persons granted bail in this case are Ketan Thacker and Nimay Agarwal.
CCI counsel Satish Maneshinde argued before the high court today that 11 persons, in connivance with Thacker and Agarwal, had tampered with the computer records of the club to secure membership.
This was a fraud committed on the club, he said and urged for a stay on the bail granted to the duo.
Mansehinde said although the accused were granted relief by a sessions court they are not released from judicial custody.
He prayed the court to stay the bail order until further hearing of the club's plea.
The court, however, refused to grant a stay on the bail order of the two accused saying, "If your case is proved then we can still arrest them".
The matter is adjourned to October 4.
According to police, Thacker and Agrawal are among the 11 people who became members of the club by allegedly forging CCI documents and reviving membership of 11 deceased members.
The EOW registered an FIR after the club completed an internal inquiry and found that the 11 people had allegedly colluded with club staff and acquired memberships by pasting their personal details on the documents of deceased members.
The case was registered initially by Marine Drive Police and later it was transferred to EOW. A case of cheating and forgery under IPC and under the provisions of Information Technology Act had been registered.
