The Palghar district rural police filed a chargesheet in the court of the First Class Judicial Magistrate today, against two teachers who allegedly beat up students of the Vagad Gurukul International School at Sakwar village in Virar (East), district police sources said.
Investigations by DYSP Vijaykant Sagar of the Boisar division based on forensic report, postmortem report and viscera report concluded that the recent death of three students was accidental and accordingly a chargesheet was filed in court today.
The police dropped charges of abetment of suicide against the two teachers who were arrested in connection with the incident.
Addressing an impromptu news conference here this evening, DSP Palghar Suvez Haq told reporters that the chargesheet has been filed against the teachers under Sections 324 read with Section 34 of the Indian Penal Code as well as Section 23 of The Juvenile Justice (Care and Protection of Children) Act, 2000.
He told reporters that it on August 25, 2014 three children of a residential school were reported missing by the school management.
On August 27, 2014, bodies of Meet Chhadwa, Khushal Dagha and Prahul Patel, who are 14-year-old ninth standard students were found on the banks of the river near the school compound.
After a complaint by a parent of one of the deceased students, that two teachers of the school had been constantly beating up the three children who might have commited suicide, the police registered offences under Section 305, Section 324, read with Section 34 of the Indian Penal Code, besides Section 23 of The Juvenile Justice (Care and Protection of Children) Act, 2000.
Some students of the school informed the police that they saw the three children escape from school.
The students told the police in their statement that on the fateful day the three students and other students were caned by the Sanskrit teacher for getting less marks and he was also likely to punish them again the next day.
Since the physical training teacher was also beating up students, the three students escaped from the school, the students told the police in their statement.
The police chief said that the three students fell into the water of the Sukh river and drowned, while running away from the school.
He said that prima facie it has come to light that the first accused was caning childen for scoring less marks in Sanskrit, while the physical training teacher beat up students with a whistle rope.
The police has filed a chargesheet against them under the relevant sections, the police chief said.
