Consumer court issues bailable warrant against Unitech officer

A bailable warrant has been issued against Unitech Ltd Director Sanjay Chandra for non-compliance of a Delhi consumer commission order asking the firm to pay back money to joint buyers who were not given possession of their flats in a proposed project at Greater Noida in UP.
"Issue bailable warrant for a sum of Rs 50,000 against Sanjay Chandra, Director for Judgement Debtor (firm)," Delhi State Consumer Disputes Redressal Commission bench of member (Judicial) O P Gupta said.
The bench passed the order on a plea moved by complainants Saira Mansoor and Mansoor Ellahi submitting that the firm's property, which was to be attached as per commission's earlier order, was already mortgaged with the bank and its two bank accounts did not have money.
Advocate Jalaj Agarwal, who appeared for the complainants, said the Delhi State Consumer Commission had earlier ordered attachment of Unitech's property after it failed to comply with the order of July last year.
According to complaint, Saira and Ellahi had booked a flat in the firm's proposed project in Greater Noida.
The firm had issued an allotment letter in 2006 by which the purchasers had to get the possession of the flat by 2008, the complaint said.
Total sale consideration of flat was Rs 47,08,187 which was paid by them by May 2008, it said, adding that later, they found that the construction of the property was still at the initial stage. The buyers tried to approach the builder but failed, it added.
Thereafter, the complainants approached the commission seeking a direction to the firm to hand over the flat and pay a compensation of Rs 20.5 lakh.
In an order passed in July last year, the commission had asked the firm to pay back the money to the complainants, along with a compensation.
In February, the firm's official had assured the court that they would give the money within four weeks.
When they failed to do so, the commission on March 17 ordered attachment of their property.
