Court notice to accused who thrashed witness

Seven persons who are facing trial in a kidnapping case have been asked by a Delhi court to respond to a plea for cancellation of their bail for allegedly thrashing a witness in the Saket court complex recently.
Jagat Singh Nagar and Parveen Nagar along with four others, all of whom are accused of abducting and looting a driver in March 2010, allegedly assaulted a doctor, who was the owner of the vehicle and had come to depose as a witness.
Additional Sessions Judge Jitender Mishra issued notice for April 7 to the seven accused on the application filed by victim Ramesh Sharma seeking cancellation of their bail.
Besides Jagat and Parveen other facing trial are -- Nitin Nagar, Tarun Nagar, Jagir Singh, Krishna Pal and Vijender Singh -- all residents of Delhi.
Ramesh in his plea had alleged that doctor Hans Nagar, who is a material witness in the present case, was dragged outside the court room on March 1 and was badly beaten by all the accused with the help of some lawyers.
Ramesh also said that Hans Nagar was not only physically assaulted by accused but was threatened with dire consequences.
He further said that his lawyer was also assaulted and was asked to leave his case.
"He (advocate) was neither permitted to enter the court room, nor allowed to appear as a lawyer in the court on my behalf," Ramesh said in his application.
He stated that the magistrate has also refused to take any action against the accused due to their "high handedness".
"The accused persons, after securing bail, have misused their liberty, by assaulting physically the material witness, doctor Hans Nagar, thereby causing grievous hurt to him and the complainant's lawyer Karan Chaudhary, to pressurise him and his witnesses to withdraw the case," Ramesh said.
The bail granted to the accused may kindly be cancelled, he added.
