The court has passed the interim order on the elderly man's suit filed against his grandson, who has allegedly forged and fabricated documents giving him a share of the property.
"The defendant (grandson), his family members...Are hereby restrained from forcibly dispossessing the plaintiff, a senior citizen aged 92 years, from the suit property or from disposing of or creating any third party interest in the suit property in Karol Bagh... By way of sale, mortgage, transfer etc till the next date of hearing," Additional District Judge Kamini Lau said.
The court noted that the grandson has already been served with the notice and he has to file written statement by August 14 in the matter.
The man alleged in the suit that he has been cheated by his grandson who has fraudulently executed a gift deed in his favour by deliberately inserting more share to himself.
The plea said the plaintiff had no intention to give that share to the grandson as he has already given it to his daughter by executing a will in her favour and it has been registered before the registrar.
He also sought a direction to declare him as the exclusive owner of the shop, which was purchased by him, along with his father, in January 1961.
