Delhi HC orders filing of FIR against CRPF doctors

The Delhi High Court has ordered filing of FIRs against three senior doctors of paramilitary CRPF in a case of alleged forging of medical records of an IG rank officer who was under their observation for getting a health clearance for his promotion.
Justice Ved Prakash Vaid has restored an earlier order of the Metropolitan Magistrate, Delhi, which had issued similar directives to the Delhi Police on February 27 last year in this case.
The case pertains to Central Reserve Police Force Inspector General (Training) S S Sandhu who was demoted last year by the Union Home Ministry on the basis of his negative physical fitness records.
Sandhu had petitioned the court alleging his medical records were "forged and a criminal conspiracy" was hatched against him in this case by the doctors of the paramilitary and a few others.
"From the foregoing discussion, it is evident that whenever a Magistrate directs an investigation on a complaint, the police have to register a cognizable case on that complaint treating the same as the FIR and comply with requirements of the above rules," the Delhi High Court said in its order of May 26.
The HC said "there are evidently cuttings in the said medical record (of Sandhu)."
"The questions: who made those cuttings? Under what circumstances those cuttings were made? Why those cuttings were made? Why the maker of those cuttings did not put counter sign on the said cuttings and questions of like nature need investigation. The said points need thorough investigation which can be done by the police after FIR is registered," the Court said.
Sandhu, in his complaint to the SHO of R K Puram police station, DCP (South District) and the Delhi Police Commissioner has sought filing of FIR against three doctors of the paramilitary-- Dr S N Kumar who is now retired, Dr Sanju Singh, the then Chief Medical Officer of CRPF, and Dr R K Dhawan Director (Medical) of CRPF.
The doctors too have filed separate petitions in various courts denying any wrongdoing.
