Domestic violence case: Court allows man to live in own house

A man, who had to vacate his flat after his wife obtained a restraining order against him in a domestic violence case, has been allowed by a Delhi court to reside in one room of the house as he had nowhere else to go.
Metropolitan Magistrate Shivani Chauhan allowed the man's plea to reside in his flat where his wife was living, with the condition that he can't enter the house after 11.30 PM.
"In the interest of justice, the man is at liberty to reside in one room of the flat and use common areas of the house but he will not enter the flat between 11.30 PM and 5.30 AM.
"It is clarified the he can access his flat throughout the day and reside in his room at night provided his entry is not delayed beyond 11.30 PM," the magistrate said.
The court also said, as a safety measure, the man has to get two CCTV cameras, with audio-video recording facility, installed at his expense at the entrance and lobby of the house as per the discretion of the woman, within 15 days.
"If the woman fails to specify the placement of the camera, then one camera shall be placed at the entrance and one in the drawing room of the house," the court said.
The court's order came in a case of domestic violence filed by the man's wife against him.
It, however, referred the matter to the mediation cell after both, the woman and the man, submitted that there was a possibility of an amicable settlement between them.
"At the joint request, the matter is referred to the Mediation Centre. The parties are directed to appear before the Mediation Cell for exploring the possibility of compromise on August 7, 2014," the magistrate said.
