Drunk driver is danger to society: Court

A drunk driver is a danger to society, a Delhi court has observed while refusing to set aside the ten-day jail term awarded to a man.
"So far so the sentence is concerned, ten days simple imprisonment for the offence punishable under Section 185 (drunken driving) of Motor Vehicles Act is not too harsh. A drunken driver is a danger to society," Additional Sessions Judge Atul Kumar Garg said.
The court, while dismissing the plea of Girja Shankar Tiwari against a magisterial court order that had awarded the sentence, said the magistrate has "not committed any error" while sentencing him, "considering that he was driving a commercial vehicle after consuming liquor in high quantity."
The judge upheld the trial court's September 27 this year order that had also imposed a fine of Rs 13,500 besides suspending his driving licence for ten months.
Tiwari, in his appeal, contended that the order was "contrary to law and wholly based on presumptions, conjectures, illegalities, surmises and lack of application of judicial pronouncements."
The convict, a driver by profession, had sought leniency from the court on the ground that he had to take care of his seven-year old son.
The court, however, rejected his plea saying there was no merit in it and ordered that he be take in custody to undergo the sentence.
