EC says election officers would be decided by it

The Election Commission today submitted in the Madras High Court that under Article 324 (6) of the Constitution, it has been vested with superintendence and control of elections and it will decide as to which officer shall be appointed for which purpose.
An affidavit in this regard was given by the EC before Justice R Subbiah on a writ petition by DMK seeking a direction to the Commission to appoint central government officials to check up the voters list.
"Under 324(6) of the Constitution of India, ECI shall be made available with such staff as may be necessary for discharge of the functions and it is for ECI to decide as to which officer shall be appointed for which purpose and no direction can be sought for from the Court by any person in this regard, as it would amount to interference with the independent functioning of Election Commission," the affidavit said.
It further said who should be notified as the Electoral Registration Officer is the absolute discretion of the EC.
The prayer of DMK to appoint central government officials as electoral registration officers and booth level officer is not maintainable and liable to be rejected, the EC submitted.
The judge after quoting the notification issued by the Registry that all the election related matters shall be placed before the First Bench directed the Registry to list it before the First Bench by tomorrow.
