The Madras High Court today allowed the state government to proceed with the tender process for supply of eggs to anganwadis for one year between August 1, 2017 and July 31 next but said it shall be subject to the result of a writ petition.
Justice M. Duraiswamy was passing interim orders on a petition filed by K.Ilayaraja, proprietor, Hi-Tech Fisheries trading company, Namakkal district.
The judge also issued notice to special government pleader Balamurugan on behalf of Secretary, Social Welfare Nutritious Meal Programme Department and Additional Advocate General STS Moorty on behalf of Department of Integrated Child Development Services Scheme, Tamil Nadu government, and directed them to file their counter by July 25.
The above tender was issued for the procurement of 52 lakh eggs per day enabling its supply to anganwadis in the state. The tender notification was issued on June 14 and is scheduled to be opened on July 14.
The petitioner challenged certain conditions of the tender which included supply of 52 lakhs egg per day by a single tenderer.
He alleged that that with a motive to help existing tenderers and to prevent a newcomer from taking part in the contract, the authorities introduced "certain unworkable conditions."
The petitioner sought a direction from the court for staying the tender till the disposal of the writ petition and a direction to auhtorities to receive his tender application.
