A petition in this regard was mentioned before a bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar which said that the matter will be heard in routine course.
The bench also expressed its displeasure that the petitioner was canvassing the case before the press and media.
An official notification from Ministry of Law yesterday said Justice Dipak Misra, the senior most judge in the Supreme Court, will be the 45th Chief Justice of India, succeeding incumbent J S Khehar.
His plea for an early hearing did not impress the bench which said, "It will come up in due course".
"You are canvassing your case in press. It is very inappropriate," it added when advocate Mathews J Nedumpara, appearing for the petitioner, mentioned it.
