HC directs CBI to re-investigate 2009 police-advocates clash

The Madras High Court today directed the CBI to re-investigate the February 19, 2009 clashes between police and advocates in its premises and file additional charge sheet while cautioning it not to create a situation to transfer the probe to some other agency.
"We do not consider this case as a proper and fit case for transfering from the CBI to some other agency," a full bench, comprising Justice S Rajeswaran, Justice R Subbaiah and Justice A Arumugaswamy, said.
The full bench rejected the request of the Tamil Nadu Advocates Association and Women Lawyers Association of the High Court to transfer the investigation to some other agency.
Disposing of their petitions, it also directed the associations to submit relevant materials which would be helpful to CBI for further investigation, within two months.
It also directed the CBI to proceed with the probe with all seriousness and file additional final report within a period of three months thereafter.
The bench also cautioned the CBI not to create a situation compelling the court to transfer the investigation to some other agency.
In its previous two separate charge sheets, CBI had named 32 advocates and five police constables as accused in the case.
The associations, not satisfied with CBI's probe, had filed the criminal original petitions seeking a direction to transfer the probe to any other agency like Special Investigation Team.
