A division bench headed by Chief Justice D H Waghela gave the direction while disposing of a PIL by social activist Vishwanath Swami, seeking a direction or order to Bar Council of India to frame rules controlling and disciplining advocates on rolls of State Bar Councils throughout India,with regard to their repeated act of striking work in courts, including boycott on excuses found to be convenient to them.
The court further directed the RG "to make suitable amendments to the rules laying down the conditions, subject to which an advocate shall be permitted to practice in the High Court and in the subordinate courts in the light of the directions of the Supreme Court in the Harish Uppal vs Union Of India & another case (2003)."
"In implementing the aforesaid direction, the committee may take note of the rules frames by various High Courts in this regard", the court said.
