HC directs police to file counter

Madras High Court today directed police not to disturb the 16-year-old boy, who suffered bullet injuries after the pistol of a police officer went off while being questioned at a police station and taking treatment in a corporate Hospital, till a counter is filed explaining his health status.
Counsel for the boy submitted that he was admitted to Global Hospitals, Perambakkam, and since the time of injury it was extremely difficult for him to move his neck freely.
The Additional Public Prosecutor in his submission said as per the Medical report, the detenu is perfectly alright and is eligible to get discharged and to be treated as outpatient periodically.

He further submitted that the Government has already paid a sum of Rs.One lakh as solatium, and the entire medical expenses are being taken care of by police.
A Division Bench of Justice S.Rajeswaran and Justice P.N.Prakash directed police to file a detailed counter explaining all the things to enable the court to pass orders. Until such time, he need not be discharged, the court said and posted the matter for further hearing on February 12.
The boy's mother had filed a Habeas Corpus plea demanding immediate release of the boy besides quality medical treatment to him at a corporate hospital in the city.

In her plea, she also sought an inquiry by a district judge-level officer into the "illegal arrest, detention and torture of the boy at the hands of the inspector who allegedly threatened him with a gun."
The state government had submitted on January 10 that the boy was receiving proper medical treatment and the matter was adjourned to today for further proceedings.
Inspector Pushparaj involved in the January 7 incident had already been suspended. An FIR under IPC Section 338 (causing grievous hurt by act endangering life or personal safety of others) was also filed against him.
