HC dismisses PIL against temple tower image in TN Govt emblem

Madras High Court today dismissed a PIL against the inscription of a temple tower in the Tamil Nadu government emblem.
Just because temple tower was inscribed in the emblem, it cannot be said the state government was giving preference or encouraging a particular religion, First Bench comprising Acting Chief Justice R K Agrawal and Justice M Sathyanarayanan ruled.
The court also rejected another prayer of petitioner R Kannan Govindarajulu that the national flag depicted in the emblem should be rearranged to meet prescribed norms.
The petitioner had sought a direction to replace the image of temple tower and rearrange the national flag to its correct specifications in the emblem.

The Judges said no finger has been raised with regard to any preference by the state government in favour of any particular religion.
On the prayer related to national flag, they said none of the provisions of The Emblems and Names (Prevention of Improper Use) Act, 1950 and Flag Code of India, 2002 had been violated.
Respect and dignity of the national flag had been preserved in the state emblem and therefore, it cannot be said the display was against provisions of the above act, the court said and dismissed the PIL.
