Madras High Court today dismissed a PIL which sought a direction to the Chief Election Commissioner to countermand the June 27 Rajya Sabha biennial elections from Tamil Nadu on the grounds of alleged horse trading.
First Bench, comprising, Acting Chief Justice Rajesh Kumar Agrawal and Justice M Sathyanarayanan dismissed the petition.
Since the election process was underway the court did not want to interfere in it, it held.
P G Sathyalaya Ramakrishnan of Chennai, in his petition, alleged that both the DMK (23 MLAs) and DMDK (29) did not have sufficient first preference votes for electing their respective candidates were hence resorted to 'horse trading'.
He also prayed for an interim order restraining the CEC from declaring the results of the polls till disposal of the present petition.
