During the last hearing, the court had sought a reply from the CBI about the status of the state government's recommendation for a probe by the agency in the encounter case.
Singh, 47, who was wanted in several cases including murder, was shot dead on June 24. His body was kept in a freezer for nearly three weeks as his family demanded a CBI probe.
"On basis of the grounds provided by the Supreme Court for a CBI probe, the CBI did not find the case eligible for investigation and hence submitted its refusal," CBI's counsel, Sachin Acharya, said.
Two cases, one each with the Churu Police and the Ratangarh Police, were filed in the matter and the state government had written to the CBI to take both up for probe.
Goverdhan Singh, the counsel of the petitioner, pleaded with the court to get the matter investigated under its supervision but it was also turned down by the court while disposing of the petition.
State counsel S K Vyas assured the court that the police investigation in the two cases was being conducted fairly and impartially.
"Even if they have any grievance or complaint, the court asked them to file a fresh petition in the district and sessions court of Churu itself," Vyas said.
