Madras High court has granted anticipatory bail to S Gurumurthy whose nomination papers as BJP's candidate in Nilgiris Lok Sabha constituency were rejected by the Returning Officer as he had not submitted necessary documents last month.
He sought anticipatory bail since his name had been included in a case of group clash by Upper Coonoor police on May 17, after two groups of BJP cadres clashed over celebrating the party's victory.
Justice R Mahadevan, granting conditional relief to Gurumurthy, directed him to appear before police daily at 10.30am every day for three weeks. He shall execute a personal bond for Rs 10,000 and furnish two sureties too for a like sum, the judge said.
In his anticipatory bail petition, Gurumurthy said he and his three associates were assaulted by others, who also lodged a complaint against them.
Counsel A Sirajuddin submitted that it was Gurumurthy and his associates who had sustained injuries in the incident, and that the FIR did not disclose that anyone from the complainant's side suffered injuries. Noting that they were innocent victims and had no criminal antecedents, counsel prayed that they be granted anticipatory bail.
RO Nilgris (SC) constituency P Shankar had rejected the nomination papers of Gurumurthy on technical grounds, citing delayed submission of "B form".
