HC issues warrant against BDO for not following its order

Madras High Court has issued a Non Bailable Warrant against a Block Development Officer in Gudalur Panchayat Union in Nilgiris over the BDO not following its order on promotion of an employee and directed that he be produced in court on June 13.
Justice M S Ramesh issued the NBW when a contempt petition by a retired employee P Chandran came up,stating that the High Court's order over his promotion was not obeyed by the BDO.
The judge also directed the Superintendent of Police, Nilgiris, to execute the NBW and produce the BDO before the cort on June 13.
The petitioner submitted that he was appointed as Village Headman for Padanthorai and Devala villages from October 4 1980 to November 14 1980. After retrenchment due to abolition of Village Head posts,he was appointed by the BDO as Panchayat Assistant as per a December 28 1990 Government Order.
He was transferred to Masinakudi Panchayat where he retired on February 28 2013. During his service he sought promotion as per 10 per cent reservation provided to Junior Assistant posts for in service candidates for which the qualification was SSLC, which he had fulfilled
He made several representations to BDO from 2004 till 2009 to consider his promotion but nothing came of it. After retirement he received a communication on May 15 2013 stating he was not eligble for promotion as he had already retired
Chandran then moved court, which set aside the BDO's order and directed him to consider the representation of the petitioner within eight weeks after obtaining a fresh representation from him.
The petitioner made a fresh representation on November 23 2016 following which the BDO informed him that his request has been considered after obtaining necessary orders from Tamil Nadu public Service Commission
Chandran submitted that despite the High Court's order,the BDO had not considered it and made a request to TNPSC,which was in no way connected to the matter.
The petitioner also submitted that the BDO alone is the competent authority to decide on his promotion
When the matter came up on Friday Justice Ramesh, apart from issuing the NBW, directed the SP, Nilgiris to produce the BDO before the court on June 13.
