Observing that police investigation was not satisfactory, Bombay High Court today directed CBI to take over the probe into the death of a student of Symbiosis Institute of Design in Pune two years ago.
Sanam Hassan (18) collapsed at a flat in Pune where she was celebrating her birthday with her friends and was declared dead when taken to the hospital.
Her mother, Nagina Hassan, had moved the High Court saying the death took place in suspicious circumstances and the Crime Investigation Department's probe was not satisfactory.
The division bench of Justices V M Kanade and P D Kode today directed CBI to file a probe report within six weeks.
The CID had told the court that Hassan died due to cardiac arrest caused by excessive intake of alcohol.
But the girl's parents said she never drank and there were discrepancies in reports of Sassoon Hospital in Pune and Mumbai's Kalina Forensic Lab.
According to Hassan's lawyer, Aniket Nikam, Sanam celebrated her birthday with friends on October 3, 2012. The The next day her parents were informed that she had been taken to the Ruby Hall Clinic where she was declared dead on arrival.
The petition alleges that forensic report said the heart which examined was a male heart, and DNA report of vaginal swab did not match the DNA profile of parents.
Advocate Nikam argued that Sanam died on her birthday, but her mobile phone had no birthday messages or any record of calls, which was strange.
Police had said that watchman of the society was not traceable, but made no efforts to trace him, he said.
