HC quashes Centre's orders revoking PML MLA's detention under NSA

Madras High Court today set aside two central government orders revoking detention under the National Security Act (NSA) against PMK MLA J Guru, who was arrested on charges of making provocative speeches at a party youth wing meet.
The orders of the Centre were not reasoned and "non-speaking orders", a division bench comprising Justice S Rajeswaran and Justice A Arumugaswamy held allowing a petition by Kancheepuram District Collector challenging the revocation of the detention of Guru under the NSA in May and July last.
The petitioner submitted, Guru was arrested in connection with the provocative speech made by him at the annual conference organised by PMK Youth wing in Mamallapuram and later provisions of NSA were invoked against him May 10, 2013.
This was revoked by the central government by a July 1 order on a representation from Guru. Again the state government passed a detention order under the NSA against Guru on July 3, which was also revoked by the Centre on August 25.
A day later, state government passed a third detention order and filed the present petition.
Elaborate arguments were presented by senior advocate K T S Tulsi on behalf of the state government, Additional Solicitor General P Wilson on behalf of the Centre and senior lawyer N R Elango for Guru, following which the court set aside the Centre's orders.
The bench, however, gave liberty to Guru to make his contentions assailing the detention orders in a Habeas Corpus Petition.
