Justice Harsha Devani passed the restraining order against Wim Plast as an interim relief to Symphony Ltd.
"By way of ad-interim relief, the respondents (Cello and Wim Plast) are restrained from marketing, selling, advertising and directly or indirectly dealing in air coolers which have the same design, shape, configuration and design identical to the petitioner's (Symphony's) designs of models Winter, Sumo, Diet and Hicool," Justice Devani said.
Symphony Ltd's petition says that Wim Plast's 'Mega Cool' air cooler model is more or less identical to Symphony's 'Winter' model, its 'Maxi Cool' model is similar to Symphony's 'Sumo' model,'Ever Cool' is identical to Symphony's 'Diet' model and 'Ultra Cool' model is quite similar to Symphony's 'Hi-Cool' model.
