This scheme is being implemented in the state for the welfare of children of labourer women, specially engaged in construction work.
The Lucknow bench of the Court has asked Principal Secretary, Women and Child Welfare Department to file counter affidavit furnishing details of money, which was provided to NGOs under the scheme.
A division bench of Justice V K Shukla and Justice B K Srivastava passed this order on a PIL filed by a lawyer.
Petitioner sought direction for independent inquiry in this connection.
On behalf of the state government, PIL was opposed submitting that alleged NGOs were not made party in the litigation and it was matter related to service therefore as per rulings it was not maintainable.
State government counsel H K Bhat also argued that petitioner has not disclosed his credentials in the PIL as per relevant rules.
The court issued notices to Central Social Welfare Board, UP State Social Welfare Board and UP Building and Other Construction Workers Welfare Board in this matter and directed to list this matter after four months.
