A division bench of Chief Justice R Subhash Reddy and Justice V M Pancholi set aside a part of rule 7(2)(B) of Gujarat State Judicial Service (GSJS) Rules "to the extent it requires experience of five years".
As the other candidates (i.E., lawyers/fresh law graduates) taking GSJS exam for civil judge's post do not need any experience, such a requirement for those working in courts and allied departments was discriminatory, the court said.
In an interim order, the high court had allowed them to appear for the preliminary examination on January 29.
They can now appear for the main written examination on March 19, if they clear the first examination, the court said.
