The Bombay High Court today asked the Criminal Investigation Department (CID) to file an affidavit on its probe into the death of a girl student of Symbiosis Institute of Design, at Pune last October.
"Answer the parents' concern. You have to be very sensitive in dealing with this case," said the division bench of Justices S C Dharmadhikari and G S Patel.
The student Sanam Hassan's mother Nagina Hassan, a resident of Versova here, has moved the court, alleging her daughter died in Pune under suspicious circumstances last October but the police probe is not satisfactory. She has demanded a CBI inquiry.
According to the petition, the victim had on October 3, 2012, gone out for a party with her friends to celebrate her birthday. The next day her parents were informed that Sanam had been taken to the Ruby Hall Clinic where she was declared dead on arrival.
The petition alleges forensic tests were inconclusive and confusing; the report said the heart which was examined was of a male. Vaginal swabs of the victim did not match with her parents' DNA. The post-mortem report did not comment on the cause of death as the chemical analysis report was yet to come.
According to Hassan, police gave them no satisfactory answers about the probe, so they approached the Home Minister who transferred the investigation to CID.
Advocate Aniket Nikam, her lawyer, today argued that one year on, there had been no progress. "The entire investigation has been done in an extremely shoddy manner," he said, adding CBI should probe the case.
The court expressed surprise about the forensic reports and asked how wrong samples were sent.
Government lawyer said another set of tests will be conducted soon to clear doubts and the probe is being carried out from all angles.
The court then directed the CID to file the affidavit and adjourned the hearing to October 28.
