Incentive increment cannot be claimed after retirement: HC

A person cannot claim incentive increment for acquiring postgraduate degree after retirement, Madras High Court ruled today.
Dismissing a plea by one S Thangathai, a retired physical education school teacher, Justices V Ramasubramanian and N Kirubakaran said the objective of incentive increment for acquiring postgraduate degree was to encourage teachers to pursue higher education so that students also benefit.
"But in this case, the appellant is a physical education teacher. We do not know how the acquisition of undergraduate degree and postgraduate degree in history would have ensured to the benefit of the students especially from a physical education teacher," the HC bench said.

The judges said the claim of the appellant for increment was due in 1991. She retired in 2005 and came to the court in 2014.
"The single judge was perfectly justified in dismissing the claim, fortunately without imposing cost," the judges said dismissing the appeal.
