Cross examination of witnesses is an integral part of the principle of natural justice and evidence recorded behind the back of the delinquent cannot be relied upon, he said while delivering a lecture organised by Central Vigilance Commission (CVC) on "Fair Investigation and Trial and Disciplinary Proceedings".
Justice Chauhan said that the fair investigation is a part of fundamental rights under Articles 20 and 21 of the Constitution of India and for this reason the investigation must be fair, transparent and judicious, as per an official release.
