"Gossip Girl" star Kelly Rutherford has won sole custody of her two children following a lengthy legal battle.
A judge gave the 46-year-old actress temporary custody after ruling that the two children must be brought back to the US from Monaco, where they had been living with their father Daniel Giersch since 2012, reported Hollywood Life.
According to a court order, Hermes and Helena must return to Los Angeles, where Rutherford will keep their passports.
The actress has been fighting for custody of her children since 2012, when it was ruled that the children could stay with Rutherford's ex-husband in Europe even though they shared joint custody.
Giersch is unable to return to the US after his visa was revoked.
Speaking after the ruling, Rutherford's lawyer Wendy Murphy said: "We are ecstatic, and hopeful that Monaco will respect the California court's ruling and send the children home. It has long been our position that Monaco has no jurisdiction because Hermes and Helena, as American citizens, have an absolute right to live in their own country.
"If the citizenship shoe were on the other foot and these children were citizens of Monaco, I have no doubt the United States would respect their right to reside in Monaco.
"Monaco officials know that sending the children back to America is the right thing to do. I'm looking forward to the happy reunion of the children not only with their mother, but also with their country."
Rutherford starred as Lily van der Woodsen on "Gossip Girl" throughout its run between 2007 and 2012.
