Lawyer alleges court didn't follow procedure in rape case

A Mumbai-based lawyer has written to the Chief Justice of India and the four senior most judges of the Supreme Court alleging that proper procedure was not followed by a Pune trial court in dealing with an alleged rape case.
The lawyer, who has written to the CJI and others, told a press conference here that while granting anticipatory bail to an accused in an alleged rape case, the trial court judge did not allow in-camera hearing in the matter which had revealed the victim's identity.
Advocate Dipti Srivatsan Kale, who is representing the victim, also alleged that the Mumbai High Court has kept her appeal against the anticipatory bail granted to the accused, Rohit Tilak, pending for four months.
She said she has also pleaded before the apex court for invocation of writ jurisdiction for violation of the victims's fundamental rights.
The lawyer said the victim had filed a transfer application with the district judge, which was also summarily dismissed.
She said the accused was roaming free despite serious rape allegations against him. The 41-year-old woman had lodged a complaint against Tilak on July 17 last year, accusing him of forcing her to have sex with him since March 2015 on the pretext of marriage.
