Tomlinson, 24, filed for joint custody of his son after Briana's inconsistency in giving him access to Freddie, reported Femalefirst.
The singer was allowed to see his son for several hours at a time with no overnight visits, according to the pair's current legal arrangement, but he wants to have more access to the five-month-old toddler.
Tomlinson became a father in January after Briana gave birth to their son Freddie Reign.
The singer asked that the pair get equal time with their son, who currently lives with Briana in a rented USD 1 million home in Calabasas, paid for by Tomlinson.
