The Maharashtra government has constituted a cabinet sub-committee to decide the fate ofthose employees whohave secured government job using a fake caste certificate of SC, STand OBC.

The general administration department (GAD) today issued a government resolution (GR) in this regard.

The Supreme Court had in July 2017 passed an order that anyonefound guilty of using a forged caste certificate for getting educationand employment will lose their degree and job as well.

The apex court had also said that such employees are liable for punishment irrespective of the years of service.

The government had sought the opinion from the law and judiciary department and the advocate general (AG).

"The consultations have, however, failed to provide succour from the AG and the law and judiciary department, with bothunanimously holding that the SC order was unambiguous about dismissalbeing the punishment for beneficiaries of the fraud," a government official said.

The GR issued today states that these employees would be treated as'open' category employees and allowed to create new posts for the reserved category hampered by the SC decision.

No action be taken against any of the 'bogus' employees till the sub-committee submits its report to the government, the GR said.
