"The matter is being inquired and verified from both the sides. The preliminary information differs from what is stated by the complainant," said DCP (Zone VI) Sangramsingh Nishandar.
Anil Rajpal had claimed that he was assaulted by sub-inspector Sandeep Sonwalkar, attached to Chembur police station, on November 22.
Rajpal, a resident of Chembur, said that he had lodged an FIR at Chembur police station on November 21 for theft of three mobile phone handsets of his elder brother.
The complainant said Sonwalkar abused and assaulted him inside the police station after he reached there, and also imposed a fine of Rs 1250 on him under section 110 of the Bombay Police Act.
Rajpal claimed that he was told to appear before a magisterial court next day, where he found that the police had not forwarded relevant papers, following which the court asked him to appear next day.
Rajpal has filed a written complaint against Sonwalkar to the Commissioner of Police Ahmed Javed.
"There are two medical reports of Rajpal. His medical test was done at 1.30 AM (on November 22) when Chembur police had taken him to Shatabdi hospital. The first medical report indicated no injury on Rajpal's body but stated that he was under the influence of alcohol," he told PTI tonight.
The sub-inspector said that Rajpal got the medical test done for the second time at the same hospital on November 22.
"On the same day in afternoon, Rajpal went to Shatabdi Hospital again and got the second medical test done. This second report indicated injury on his body but not alcohol content in its blood," he said, adding that both reports are contradictory.
