Additional Sessions Judge J P S Malik handed down the jail term to UP resident Chander Pal for hitting his younger brother Kishan with a spade and burying his body to evade arrest. The court also imposed Rs 12,000 fine on him.
The court, while convicting Chander, relied on the testimonies of the police officials and prosecution evidence regarding exhumation of the victim's body and his post mortem report.
"Body of Kishan Pal was found buried in Neb Sarai, which was exhumed. It was buried by the accused, knowing that murder of Kishan Pal had been committed and the same was done with the intention of screening himself from legal punishment," the court said.
The court, however, rejected the motive alleged by the prosecution that Chander was in an illicit relationship with Kishan's wife, which kept the brothers at loggerheads.
"There is no evidence to substantiate those allegations on record," it said, adding that, the motive was not relevant in this case.
According to the prosecution, on the intervening night of May 11-12, 2008, Chander stabbed to death his brother Kishan, an auto rickshaw driver.
