Family members of a 43-year-old man, who died after being hit by a rashly driven DTC bus, have been awarded a compensation of over Rs 30 lakh by a Motor Accident Claims Tribunal (MACT) here.
The Tribunal directed the United India Insurance Company, insurer of the DTC bus, to pay Rs 30,01,456 in favour of the wife and two minor children of victim Rajesh Kumar who was riding a motorcycle when he met with an accident near ISBT here in January this year.
"After considering all the documents (FIR, mechanical inspection report etc) filed by petitioners as a whole, it is clear that respondent 1 (driver) was driving the bus in a rash and negligent manner," MACT Presiding Officer Sanjeev Kumar Singh said.
According to the petition, filed by Rajesh's wife Meenakshi, on the night of January 21, 2014, he was going on his bike from Lajpat Rai market towards ISBT here when a DTC bus came from Darya Ganj side at a high speed and hit him.
Due to the impact, Rajesh fell down on the road and his head got crushed under the tyre of the bus. He died on the spot.
Rajesh, a resident of Shahdara here, worked at a jewellery store on a salary of Rs 20,000 per month and is survived by his wife and two minor sons. Meenakshi had approached the Tribunal seeking a compensation of Rs 40,00,000 for the untimely loss of her husband.
All three respondents --Delhi Transport Corporation, the bus driver and the insurance company-- through written statements, had denied the rashness on the part of the driver and claimed the contents of the petition were false.
