Medically examine man who levelled charges against judges: HC

The Madras High Court today directed the police to get a man, who had repeatedly filed "vexatious" petitions levelling charges against its judges, medically examined to ascertain his mental health.
Justice S Nagamuthu yesterday directed Assistant Commissioner of Police, High Court, to 'lead' the man before the Commissioner of Police, Greater Chennai City, and get him medically examined by two experts for a preliminary assessment of his mental health.
The matter pertains to a man filing petitions repeatedly, charging that terrorists were killing people daily in his village in Tiruvallur district by poisoning the drinking water. He had also charged judges of the Madras High Court with supporting the terrorists.

Similar petitions filed by the man in the past had been dismissed by the court.
When the petitioner again appeared yesterday before Justice Nagamuthu, the judge concluded that no purpose would be served if any injunction was passed against him for filing vexatious litigation because of the doubt that he had about the mental health of the man.
"I do not deem it proper at this stage to initiate criminal contempt proceedings though a prima facie case is made out for I have doubt about his mental health. For any reason, if the petitioner is found mentally sound and if he files any more case of this nature, which is vexatious in nature, this Court may have to think of initiating proceedings against him under Vexatious Litigation (Prevention) Act,1949".

The Judge after directing the CoP, Chennai City to get the man medically examined, said if the CoP concludes from the medical experts' report and other material that the petitioner is mentally ill, he would then be dealt with under the provisions of The Mental Health Act, 1987.
The Judge also directed the media not to mention the petitioner's name in their reports to protect his privacy.
He also directed the CoP to inform parents of the petitioner who are in Ponneri Taluk, Tiruvallur District, about the order and directed that they be permitted to interact with the petitioner.
