Senior Counsel K V Dhananjay for Abraham submitted before the court that despite giving a representation to the commissioner on November 6 that there was a threat to Abraham's life and he needed security as it had become the norm to eliminate whistle blowers, the officer has "failed to act".

Dhananjay, quoting apex court judgements on such matters, then appealed to the court to summon the commissioner "so that he can explain his inaction on the matter".

After hearing the application against Nandi Infrastructure Corridor Enterprise (NICE), Judge N K Sudhindra Rao posted the matter to December 17 for orders.

Passing orders on Abraham's complaint, the Lokayukta court on October 25 had ordered a probe against three former chief ministers -- H D Deve Gowda, S M Krishna and B S Yeddyurappa -- and 27 others in connection with alleged corruption and illegalities in the Bangalore Mysore Infrastructure Corridor project, awarded to NICE and its sister companies, when Gowda was heading the state government.

On December 11, the Karnataka High Court had stayed for four weeks the Lokayukta court order while hearing writ petitions filed by against NICE and its sister concerns.
