Chief Judicial Magistrate Indranil Chatterjee granted the two accused, Bhagirath Ghosh and Subrata Roy, permission to record their statement on Wednesday.
Ghosh and Roy, who were in jail custody had applied for recording their statement under Section 164.
The two were accused in the murder of Sagar Ghosh, father of Hriday Ghosh, a rebel TMC candidate before the panchayat election in July 2013.
Trinamool Congress district president Anubrata Mandal was also one of the 41 accused in the case.
