Patna HC reserves order on PMC Commissioner suspension

A full bench of the Patna High Court today reserved its order on suspension of Patna Municipal Corporation commissioner Kuldip Narayan by the state government.
The bench, consisting of Justice Iqbal Ahmad Ansari, Justice V N Sinha and Justice Navniti Prasad Singh, reserved order on PMC commissioner's suspension after hearing the corporation and government counsels in the past three days.
The PMC commissioner was put under suspension by the state government last month on the charge of lax in the performance of duty.
But, a division bench of the HC, comprising Justice V N Sinha and Justice P K Jha, had stayed the suspension taking strong exception despite its order not to do so without its consent.
The bench, which is monitoring cases of construction of high rise buildings in the state capital in violation of building laws, had banned the transfer of PMC commissioner till the process to take action against errant builders was over.
The state government had earlier approached the court of the then Acting Chief Justice Iqbal Ahmad Ansari to justify its action in suspending PMC commissioner and got a favourable verdict.
But, the division bench which has been hearing a PIL on illegal buildings had taken exception to suspension and lifted the stay till further order.
The PMC commissioner's suspension order then was referred to a larger bench comprising the three Judges.
