The Allahabad High Courttoday rejected a petition challenging the dismissal of a criminal case against Uttar Pradesh Chief Minister Yogi Adityanath in an incident dating back to 1999 when he was the MP of Gorakhpur.
After hearing the concerned parties, Justice Saumitra Dayal Singh dismissed the revision petition filed by Talat Aziz, a Samajwadi Party leader.
In the petition it was alleged that a meeting was held by Aziz in Mahrajganj on February 10, 1999. But Yogi reached the venue that led to clashes.
In the ensuing violence, a police head constable Satya Prakash, who was the security guard of Aziz died due to gun shot injuries, it was alleged.
Subsequently, an FIR was lodged by Aziz at police station Kotwali Mahrajganj against Yogi and several unnamed persons.
Similarly, the then SHO Kotwali Mahrajganj, B K Srivastava also lodged an FIR naming Yogi and 21 others under section 307 (attempt to murder), 153A and other sections of Indian Penal Code.
A third FIR was then lodged by Yogi alleging that he was attacked by Aziz and his aides.
Subsequently, the case was handed over to CBCID which closed the matter by submitting its final report.
An aggrieved Aziz challenged the CBCID report and filed a protest petition before the additional chief judicial magistrate of Mahrajganj. The petition was treated as a criminal complaint case.
However, the magistrate on March 13, 2018 dismissed the case.
Aziz again challenged the judgment before the high court by filing the present criminal revision petition which was dismissed yet again.
