A PIL has been filed in the Madras High Court seeking an interim injunction to restrain MCI from implementing clause 9 (4) of the Medical Council of India PG Medical Education Regulations 2000.
The petitioner, a state government assistant surgeon, prayed for staying the admission process of PG medical admission for 2017 pending disposal of the PIL and said implementation of the clause was nothing but imposing the law,and against the federal set up.
The PIL filed by Karthik Rajan also sought a direction to fill the seats automatically as per state reservation policy for PG medical course.
He claimed that the regulation would not give autonomy to the state government in allotting seats.
When it came up today, a division bench of the court's Madurai Bench, comprising Justices A Selvam and Athinathan, issued notice to Union Health Secretary and state principal health secretary, among others, directing them to reply by June 15 and posted the case to that date.
