Justice K Ramakrishnan made the observation while staying proceedings against CPI(M) state secretary Pinarayi Vijayan, Opposition leader Kodiyeri Balakrishanan, former minister and Polit Bureau member P K Sreemathy and 16 other marxist leaders in a case relating to conduct of processions on roads, banned by the High Court years ago.
The Court granted a three-month stay and directed police to file a statement.
The proceedings were initiated on a petition by Vijayan and others against the Payyanoor magistrate court order, alleging public nuisance and conducting processions in public place.
The order was issued on a petition by Shamseer to keep in abeyance the non bailable warrant in three different cases till the election process was over. All the cases relate to conduct of demonstrations in public places.
Shamseer has filed two more petitions today, seeking similar relief.
