The warring groups of Rajasthan Cricket Association (RCA) will be testing their strengths again as Rajasthan High court ordered that the 'No Confidence Motion' will have to be tabled again.
After hearing on the writ filed by 26 petitioners including district cricket associations, their secretaries and members of the RCA executive committee members against the unfair manner in which the motion of no confidence moved by Amin Pathan & Co was conducted on March 9 in Sawai Mann Singh stadium, Justice Bela Trivedi said that there was only one solution to the deadlock that there should be fresh voting on the no confidence motion.
Honorable justice asked both the warring factions to mutually agree and put forward a name of person who would chair and supervise the voting which would be held in police supervision.
The court also made it clear that if both the parties fail to do so in the next hearing on September 28, the court would itself appoint a chairman and announce date to ensure fair and free voting on the motion.
It might be recalled that the Amin Pathan group had claimed that they have removed Lalit Modi and few other top officials in an EGM but the claim was challenged in court and later on March 9.
Former IPL commissioner Modi was removed from the post of RCA president amid chaos and controversies as a 'No Confidence Motion' against him and three other office bearers, brought in by rival Amin Pathan group was passed in an Extra Ordinary General Body Meeting (EGM) which was chaired by Sports Council Chairman JC Mahanti.
This meeting again was challenged as Modi faction alleged that the vehicles of genuine voters were mobbed, stoned and occupants were beaten and their papers of authorization were snatched by the attackers was premeditated attempt to intimidate and prevent the voters from reaching the venue of the voting.
After hearing the matter today the Hon'ble Court of Lady Justice Bela Trivedi opined that only solution to the matter was a fresh voting on the no confidence motion.
The court would decide the date of voting and would also appoint a chairman if both parties do not come up with a name after mutual consent.
The court has also constituted committees to ensure the participation of Rajasthan Cricketers in the coming domestic season of the BCCI which had suspended RCA because it had elected former IPL commissioner Lalit Modi, who is facing a life suspension, as President.
