Road accident victim's parents get over Rs 8L compensation

The parents of an 18-year-old youth, who died in a road accident involving a rashly driven trolley, have been awarded a compensation of over Rs eight lakh by a Motor Accident Claims Tribunal (MACT) here.
The tribunal directed Reliance General Insurance Company Ltd, insurer of the offending trolley, to pay Rs 8,13,500 as compensation to the parents of Uttar Pradesh resident Ashwani Kumar, who died in a road accident in 2008.
"The FIR, charge sheet, site-plan, postmortem report and the testimony of the PW-1(mother), PW-2(father) and PW-3(employer), taken together fully establish the death of Ashwani Kumar caused by the injuries sustained by him...In a road accident," MACT Presiding Officer Arvind Kumar said.
According to the petition, filed by Kumar's parents, on November 6, 2008, he was going on a motorcycle to his office and when he reached in front of Dev Motors in Gautam Budh Nagar, a trolley, driven in a rash and negligent manner, hit the two-wheeler.
Due to the impact, he had fallen down and sustained serious injuries. The bystanders had taken him to Kailash Hospital, Noida where he was declared as brought dead.
The plea had submitted that Kumar was employed as a sales executive in a private company here and claimed compensation of Rs 30 lakh.
During the trial, the driver and owner of the bus had claimed the accident had been caused because of the negligence of Kumar who was riding the motorcycle rashly and negligently.
The insurance company claimed that the driving license of the driver of the trolley was fake and hence it was not liable to pay.
The tribunal, however, rejected the contention of the insurance company and directed it to deposit the amount in the petitioner's bank account within 30 days.
